Stricter information obligations towards private persons (EN/DE/FR)

In the past, it was sufficient that debt collection agencies and lawyers examined the legality of a claim. Now, they must provide detailed information with the first request for payment, irrelevant of whether they are pre-trial or enforceable claims.

Therefore, with considerable extra effort creditors and collection companies have to list the following information:

  • Mention of the client
  •  Demand basis, such as enforceable or contractual claim
  • Contractual objects, such as rent-, purchase-, telecommunication-, or insurance contract
  •  Contract date
  • Explanation of interest, whether legal or agreed to individually
  • Explanation of collection costs

Affected by this ruling, are all claims against individual persons. On demand, even more, information needs to be provided.

The reason for this more stringent regulation is partially due to a curbing of unsound business practices, and secondly, due to an increase of consumer protection.

Verschärfte Informationspflichten gegenüber Privatpersonen

Reichte es in der Vergangenheit bisher aus, dass Inkassounternehmen und Rechtsanwälte die Rechtmäßigkeit einer Forderung prüfen, so müssen sie nunmehr detaillierte Informationen mit der ersten Zahlungsaufforderung übermitteln.  Unerheblich, ob es sich um vorgerichtliche oder titulierte Forderungen handelt.

Mit einem erheblichen Mehraufwand müssen Gläubiger und Inkassounternehmen daher die folgenden Informationen zusammen tragen:

  • Nennung des Auftraggebers
  • Forderungsgrund, z.B. titulierter oder vertraglicher Anspruch
  • Vertragsgegenstand wie z.B. Miet-, Kauf-, Telekommunikations- oder Versicherungsvertrag
  • Vertragsdatum
  • Erläuterung der Zinsen, d.h. ob gesetzlich oder individuell vereinbart
  • Erläuterung der Inkassokosten.

Betroffen von dieser Regelung sind alle Forderungen gegen Privatpersonen. Auf Nachfrage müssen sogar weitere Informationen bereitgestellt werden.

Grund für diese verschärfte Regelung ist zum einen die Eindämmung unseriöser Geschäftspraktiken und zum anderen ein zunehmender Verbraucherschutz. 

Renforcement des obligations à l’égard des particuliers

Les sociétés de recouvrement allemandes et les avocats pouvaient jusqu’à récemment se contenter de vérifier la réalité de la créance.

Ce n’est plus le cas car dès la première lettre de rappel les informations suivantes doivent être fournies au débiteur.

  • Le nom du créancier
  • Les causes de la créance
  • L’objet contractuel
  • La date du contrat
  • Une explication quant aux intérêts mis en compte
  • Des explications quant aux frais de recouvrement

Toutes les créances à l’égard de particuliers sont concernées.

Sur demande des informations complémentaires sont à fournir.

Cette nouvelle réglementation vise à  protéger le consommateur des comportements et activités commerciales peu sérieuses.
